Maharashtra Real Estate Regulatory Authority (MahaRERA) has announced that complaints made by homebuyersregarding the flats will not be entertained after acquisition. In an interesting development, the body has come up with this order that might save the interests of the developers from corrupt buyers.
The buyers cannot complain about incomplete work in the projects after acquiring them.
In case they are concerned about the completion of the project, they can draw the attention of the regulatory body to the matter before acquiring it.
This decision is likely to influence several homebuyers, who generally take possession of the apartment before the developer receives the Occupancy Certificate for the same. Although the move is going to affect the interest of the buyers, it will place them on the right track.
The regulatory body disposed off a complaint made by the members of Balaji Infinity Society, based in Pune, against the builder, Anuj Developer. MahaRERAstated that they could not entertain the plea, as the homeowners had already taken the possession of the residential apartments. Therefore, you need to place the complaint before getting a possession over the property.
The Occupancy Certificate (OC) is a document for a newly constructed building, which is issued by the local civic authority.
The document validates that the project is complete and has adhered to the approved plan. Therefore, it is fit for the occupancy of the residents.
According to the regulations, a homebuyer has the right to move into a newly completed apartment after it receives the OC. However, in Mumbai alone, several residential complexes have been occupied by the residents even before the document has been obtained.
The members of Balaji Infinity Society had already taken possession of their apartments in Pune a long time back. Therefore, the plea made by the members of the complex was not entertained by the body.
According to the complaint, the residential complex was not having all the features, as mentioned in the brochure.
The developers had not provided certain amenities to them, including gym, porch, and so on.
The complaint also stated that the fire fighting entry and exit spaces were being sold off for parking.
The developer stated that the company had completed the work in order to hand them over to the homebuyers. They also denied the charges of doing any illegal or unauthorized work in the residential complex.
According to the developer, the real estate company will complete the project along with the occupancy certificate and all the amenities that have been mentioned in the MahaRERA registration.
They said the estate will have all the amenities that have been stated in the brochure.
Coming to the completion of the common areas, MahaRERA has asked the developer to complete them while completing the registered project.
Most of the times, the residents are keen to acquire the property before it is completed. However, this decision of the authority will prevent this from happening.
As a homebuyer, you need to wait till all the features are integrated in the project and the OC has been obtained.
This is a welcome move from the authority, as the developers will get the necessary time to integrate the project with all the necessary amenities. The residents should wait till the legal proceedings are over and acquire the property once the developer obtains the OC.
